TERMS OF USE

Effective Date: March 4, 2024

This Terms of Use Agreement (the "Agreement") governs your access to and use of the website located at https://www.polyglotworks.net (the "Website"). By accessing or using the Website, you acknowledge that you have read, understood, and agree to be bound by this Agreement, along with the Privacy Policy available at https://www.polyglotworks.net/termsandconditions, which is incorporated herein by reference.

If you do not agree to this Agreement, you must discontinue all use of the Website immediately. For any questions, please contact us at polyglotworks@polyglotworks.net.

POLYGLOTWORKS reserves the right to modify this Agreement at any time. Any changes are effective upon posting to the Website unless otherwise stated.

 

1. Definitions

1.1 "POLYGLOTWORKS" refers to POLYGLOTWORKS, a limited partnership, which owns and operates the Website.
1.2 "Website" refers to https://www.polyglotworks.net and all subpages, content, and services provided through it.
1.3 "Content" refers to all materials on the Website, including text, images, graphics, programming code, media, databases, and all user-submitted materials.
1.4 "Services" refers to any products, materials, or services offered through POLYGLOTWORKS.
1.5 "User" refers to any individual or entity accessing or using the Website.

 

2. Purpose

The Website is provided for educational purposes.

 

3. Use of the Website

3.1 License Grant
POLYGLOTWORKS grants you a limited, non-exclusive, non-transferable license to access and use the Website solely for legitimate personal or business purposes in accordance with this Agreement.

3.2 Age Restrictions
The Website is not intended for children under 13. Persons aged 13 to 18 may use the Website under the supervision of their parents or guardians.

3.3 Prohibited Conduct
Users are expressly prohibited from:

  • using the Website in violation of applicable law or this Agreement,
     

  • copying, reproducing, downloading, distributing, or creating derivative works from Website Content except as expressly permitted,
     

  • using any automated system, including robots, spiders, or data mining tools, to access or extract data,
     

  • attempting to hack, breach, overload, disrupt, or circumvent any security measures of the Website, its servers, or networks,
     

  • engaging in fraudulent, deceptive, or otherwise unlawful conduct,
     

  • impersonating any person or entity or misrepresenting an affiliation,
     

  • transmitting or introducing any viruses, worms, Trojan horses, time bombs, or other harmful or disruptive code,
     

  • submitting unsolicited commercial messages, spam, chain letters, or pyramid schemes,
     

  • disrupting or interfering with the normal operation of the Website or the experience of other Users.
     

Any unauthorized use automatically terminates all rights granted under this Agreement.

3.4 Termination of Access
POLYGLOTWORKS may suspend or terminate any User's access to the Website or Services at any time, with or without cause, and with or without notice.

 

4. Information You Provide

4.1 Personal Data
Any personal information you provide via the Website will be handled in accordance with our Privacy Policy available at https://www.polyglotworks.net/termsandconditions.

4.2 Communications Security
POLYGLOTWORKS uses reasonable technical and organizational measures to protect information. However, you acknowledge that no method of transmission over the Internet is completely secure and that POLYGLOTWORKS cannot guarantee absolute security. You assume all risk associated with transmitting information to or from the Website.

4.3 Submissions and License Grant
Any information, materials, suggestions, ideas, or comments you send to us (each, a "Submission") are deemed non-confidential and non-proprietary, subject to the Privacy Policy with respect to personal data.

By sending a Submission, you grant POLYGLOTWORKS an irrevocable, worldwide, perpetual, royalty-free, transferable, and sublicensable license to use, modify, reproduce, adapt, publish, translate, create derivative works from, distribute, publicly perform, and publicly display such Submission in any media now known or later developed, for any purpose, commercial or otherwise, without compensation to you.

4.4 Prohibited Submissions
You agree that Submissions and other information you provide will not:

  • contain commercial advertising, solicitations, or links to external commercial sites except as expressly permitted,
     

  • infringe any copyright, trademark, trade secret, or other intellectual property right of any third party,
     

  • be false, misleading, fraudulent, or impersonate another person, identity, or entity,
     

  • be harmful, threatening, abusive, harassing, defamatory, obscene, invasive of privacy, or otherwise unlawful,
     

  • contain viruses, worms, Trojan horses, time bombs, or other harmful or disruptive code,
     

  • use any robot, spider, or similar device to retrieve, index, scrape, or circumvent the navigational structure or presentation of the Website.
     

 

5. Intellectual Property Rights

POLYGLOTWORKS owns all intellectual property rights relating to the POLYGLOTWORKS brand and the Website, including:

  • copyrights,
     

  • trademarks and service marks,
     

  • trade names and trade dress,
     

  • logos and branding elements,
     

  • patents and patentable subject matter,
     

  • trade secrets,
     

  • code (source and object), designs, layout, look and feel, text, graphics, images, audio, and video.
     

All rights are reserved. No license or right is granted to you except as expressly provided in this Agreement. You may not display, copy, modify, create derivative works of, sell, distribute, or otherwise exploit any Intellectual Property of POLYGLOTWORKS except as expressly permitted.

All other intellectual property not owned by POLYGLOTWORKS is the property of its respective owners or licensees.

 

6. Infringing Third-Party Intellectual Property

6.1 Policy
POLYGLOTWORKS respects the intellectual property rights of others and expects Users to do the same. In appropriate circumstances and in its discretion, POLYGLOTWORKS may terminate or suspend use of the Website by Users who infringe third-party rights.

6.2 Reporting Infringement
Only the owner of the intellectual property right or an authorized agent may report allegedly infringing material.

If you believe that your copyright or trademark is being infringed on the Website, you must provide POLYGLOTWORKS' designated agent with a written notice containing:

  • a physical or electronic signature of a person authorized to act on behalf of the owner of the exclusive right,
     

  • identification of the copyrighted work or trademark claimed to have been infringed, or, if multiple works are involved, a representative list,
     

  • identification of the material that is claimed to be infringing, and information reasonably sufficient to permit us to locate the material,
     

  • information reasonably sufficient to permit us to contact you, including name, address, telephone number, and email address,
     

  • a statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the rights owner, its agent, or the law,
     

  • a statement that the information in the notification is accurate and, under penalty of perjury, that you are authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.

Please note that under applicable law, including Section 512(f) of the United States Copyright Act, any person who knowingly materially misrepresents that material or activity is infringing may be liable for damages.

6.3 Responding to a Notice of Infringement
If your content has been removed or disabled due to a claim of infringement, you may send a counter-notice. To be effective, the counter-notice must include:

  • your physical or electronic signature,
     

  • identification of the material that has been removed or disabled and the location at which the material appeared before removal or disabling,
     

  • a statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification,
     

  • your name, address, and telephone number, and a statement that you consent to the jurisdiction of the competent courts in the jurisdiction where you reside, or if outside that jurisdiction, any jurisdiction in which POLYGLOTWORKS may be found, and that you will accept service of process from the party who submitted the original infringement notice or their agent.

POLYGLOTWORKS may, in its discretion and subject to applicable law, restore the removed material if a valid counter-notice is received and no legal action is initiated by the complaining party within the period required by law.

 

7. Disclaimers

Your consent to the following disclaimers is a material condition of your access to the Website.

THE WEBSITE AND ALL CONTENT, SERVICES, AND PRODUCTS PROVIDED BY POLYGLOTWORKS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.

POLYGLOTWORKS DISCLAIMS ALL WARRANTIES TO THE MAXIMUM EXTENT PERMITTED BY LAW, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY,
     

  • FITNESS FOR A PARTICULAR PURPOSE,
     

  • TITLE AND NON-INFRINGEMENT,
     

  • ACCURACY, RELIABILITY, OR COMPLETENESS OF CONTENT.
     

POLYGLOTWORKS DOES NOT WARRANT THAT:

  • THE WEBSITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE,
     

  • DEFECTS WILL BE CORRECTED,
     

  • THE WEBSITE OR THE SERVERS ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS,
     

  • THE RESULTS OF USING THE WEBSITE OR SERVICES WILL MEET YOUR EXPECTATIONS OR REQUIREMENTS.
     

YOU ASSUME ALL RISK FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM, DATA LOSS, OR OTHER HARM RESULTING FROM YOUR USE OF THE WEBSITE OR CONTENT.

 

8. Third Parties and Third-Party Websites

The Website may contain links to third-party websites for your convenience. These websites are not controlled or operated by POLYGLOTWORKS and may have their own terms and privacy policies.

POLYGLOTWORKS:

  • does not endorse, guarantee, or assume responsibility for any third-party websites, content, products, or services,
     

  • disclaims any liability arising from your access to or use of such third-party websites.
     

Your use of third-party websites is entirely at your own risk.

 

9. Information Monitoring and Updates

POLYGLOTWORKS attempts to ensure that information on the Website is accurate and current. However:

  • information may be incomplete, inaccurate, or out of date,
     

  • POLYGLOTWORKS makes no representation as to the completeness, accuracy, or timeliness of any information, including regarding Services, pricing, or conditions.
     

POLYGLOTWORKS has no obligation to monitor User submissions but reserves the right to review, edit, remove, or reject any content at its sole discretion.

POLYGLOTWORKS may cooperate with law enforcement and comply with lawful requests, including subpoenas, requiring disclosure of User information such as IP address, username, or contact details.

 

10. Viruses

POLYGLOTWORKS does not guarantee that the Website will be free of viruses, worms, or other harmful code.

You are responsible for implementing appropriate security safeguards, including antivirus software, firewalls, and backup procedures, suitable for your use and risk tolerance.

 

11. Limitations of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL POLYGLOTWORKS, ITS AFFILIATES, OR THEIR RESPECTIVE EMPLOYEES, OFFICERS, DIRECTORS, OR AGENTS BE LIABLE FOR:

  • ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES,
     

  • ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY,
     

  • ANY CLAIMS ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE WEBSITE OR SERVICES,
     

WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF POLYGLOTWORKS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

If a court determines that limitations of liability are unenforceable, POLYGLOTWORKS' total aggregate liability to you for all claims shall not exceed the total amount you have paid to POLYGLOTWORKS for Services giving rise to the claim.

 

12. Indemnification

You agree to indemnify, defend, and hold harmless POLYGLOTWORKS, its affiliates, and their respective officers, directors, managers, employees, agents, and contractors from and against any and all losses, liabilities, damages, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to:

  • your use of the Website or Services,
     

  • your Submissions or other information you provide,
     

  • your breach of this Agreement,
     

  • your infringement or misuse of any third-party intellectual property or other rights,
     

  • any investigation, claim, or proceeding involving your conduct by POLYGLOTWORKS, law enforcement, or governmental authorities,
     

  • your violation of any applicable law or regulation.
     

 

13. Release

To the maximum extent permitted by law, you, on behalf of yourself and your successors, assigns, heirs, and representatives, release POLYGLOTWORKS and its affiliates from any and all claims, demands, liabilities, and damages, known or unknown, arising out of or related to:

  • third-party content,
     

  • Submissions by other Users,
     

  • third-party actions or omissions in connection with the Website or Services.
     

 

14. Dispute Resolution

14.1 Governing Law
This Agreement, the Website, the Services, and any dispute, claim, or controversy arising out of or relating to them are governed by the laws of Kazakhstan, without regard to its conflict of law principles.

14.2 Negotiation
Before initiating any formal legal proceeding, the parties will attempt in good faith to resolve any dispute, claim, or controversy through negotiation.

14.3 Venue
Any dispute, claim, or proceeding arising out of or relating to the Website, Services, this Agreement, or the Privacy Policy shall be brought exclusively in the competent courts of Kazakhstan.

14.4 Jurisdiction
You and POLYGLOTWORKS irrevocably consent to the personal jurisdiction of such courts and agree that they are a convenient and appropriate forum.

14.5 Time Period for Bringing Claims
Any claim arising out of or relating to this Agreement, the Website, or the Privacy Policy must be brought within one (1) year after the cause of action accrues. After this period, such claim is permanently barred.

14.6 Fees and Costs
The prevailing party in any action or proceeding arising out of or relating to this Agreement shall be entitled to recover its reasonable attorneys' fees and costs in addition to any other relief granted.

 

15. Additional Provisions

15.1 Entire Agreement
This Agreement, together with the Privacy Policy available at https://www.polyglotworks.net/termsandconditions, constitutes the entire agreement between you and POLYGLOTWORKS concerning the Website and Services and supersedes all prior agreements or understandings, whether written or oral.

15.2 Waiver
No waiver by POLYGLOTWORKS of any term or condition of this Agreement shall be deemed a further or continuing waiver of such term or any other term, and any failure of POLYGLOTWORKS to assert a right or provision shall not constitute a waiver of such right or provision.

15.3 Severability
If any provision of this Agreement is held invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

15.4 Local Laws
Access to the Website may not be legal in certain jurisdictions. Users who choose to access the Website do so on their own initiative and are responsible for compliance with local laws.

15.5 Relationship of the Parties
Nothing in this Agreement shall be construed to create any partnership, joint venture, agency, employment, or franchise relationship between you and POLYGLOTWORKS.

15.6 Assignment
POLYGLOTWORKS may assign this Agreement and its rights and obligations hereunder at any time. You may not assign or transfer any of your rights or obligations under this Agreement without the prior written consent of POLYGLOTWORKS.

Настоящее Соглашение об условиях использования («Соглашение») регулирует ваш доступ к веб-сайту https://www.polyglotworks.net («Веб-сайт») и его использование. Получая доступ к Веб-сайту или используя его, вы подтверждаете, что ознакомлены, поняли и соглашаетесь соблюдать условия настоящего Соглашения, а также Политику конфиденциальности, доступную по адресу https://www.polyglotworks.net/termsandconditions, которая включена в настоящее Соглашение посредством ссылки.

1. Определения

3.2 Возрастные ограничения

Веб-сайт не предназначен для детей младше 13 лет.
Лица в возрасте от 13 до 18 лет могут использовать Веб-сайт под контролем родителей или законных опекунов.

3.3 Запрещенные действия

Пользователям запрещается:

использовать Веб-сайт с нарушением закона или настоящего Соглашения,

копировать, воспроизводить, скачивать, распространять или создавать производные работы на основе Контента Веб-сайта, кроме случаев, прямо разрешенных,

использовать автоматизированные системы (роботы, пауки, инструменты для сбора данных) для доступа к данным или их извлечения,

пытаться взламывать, нарушать работу, перегружать или обходить меры безопасности Веб-сайта, его серверов или сетей,

осуществлять мошенническую, вводящую в заблуждение или иную незаконную деятельность,

выдавать себя за другое лицо или организацию, либо ложно указывать принадлежность,

передавать вирусы, черви, трояны, вредоносный код или иные деструктивные элементы,

отправлять нежелательные коммерческие сообщения, спам, цепочки писем или схемы пирамид,

вмешиваться в нормальную работу Веб-сайта или мешать другим Пользователям.

Любое несанкционированное использование автоматически прекращает все предоставленные права.

3.4 Прекращение доступа

POLYGLOTWORKS может приостановить или прекратить доступ Пользователя к Веб-сайту или Услугам в любое время, с уведомлением или без.

 

4. Информация, которую вы предоставляете

4.1 Персональные данные

Любая личная информация, предоставленная через Веб-сайт, обрабатывается в соответствии с Политикой конфиденциальности.

4.2 Безопасность коммуникаций

POLYGLOTWORKS применяет разумные технические и организационные меры для защиты данных. Однако вы признаете, что передача данных через интернет не может быть абсолютно безопасной. Все риски, связанные с передачей информации, несете вы.

4.3 Переданные материалы и лицензия

Отправляя Материалы, вы предоставляете POLYGLOTWORKS безотзывную, всемирную, бессрочную, безвозмездную, передаваемую и сублицензируемую лицензию на использование, модификацию, воспроизведение, публикацию, перевод, создание производных работ, распространение и публичную демонстрацию Материалов в любых целях.

4.4 Запрещенные материалы

Вы подтверждаете, что предоставляемые материалы не будут:

содержать рекламу или ссылки без разрешения,

нарушать авторские права или иные права третьих лиц,

быть ложными, вводящими в заблуждение или поддельными,

содержать оскорбительный, вредоносный, клеветнический или незаконный контент,

содержать вредоносный код,

использовать автоматизированные средства для обхода структуры Веб-сайта.

 

5. Права интеллектуальной собственности

POLYGLOTWORKS владеет всеми правами интеллектуальной собственности, включая:

авторские права,

товарные знаки и знаки обслуживания,

коммерческие наименования и фирменный стиль,

логотипы,

патенты,

ноу-хау,

код, дизайн, текст, графику, изображения, аудио и видео.

Все права защищены. Никакие права не предоставляются вам, кроме прямо указанных.

 

6. Нарушение прав третьих лиц

6.1 Политика

POLYGLOTWORKS уважает интеллектуальную собственность третьих лиц.

6.2 Сообщение о нарушении

Только правообладатель или его представитель могут отправить жалобу. Жалоба должна содержать:

подпись заявителя,

описание нарушаемого объекта,

указание места размещения нарушающего материала,

контактные данные,

заявление о добросовестности,

заявление о точности сведений.

6.3 Ответ на жалобу

Вы можете отправить встречное уведомление, содержащее:

описание удаленного материала и место размещения,

7. Отказ от гарантий

Веб-сайт предоставляется «КАК ЕСТЬ» и «ПО МЕРЕ ДОСТУПНОСТИ».
POLYGLOTWORKS не предоставляет никаких гарантий, включая:

коммерческой пригодности,

соответствия определенной цели,

точности или полноты информации.

Вы берете на себя риск возможного ущерба.

 

8. Сторонние ресурсы

POLYGLOTWORKS не несет ответственности за сторонние сайты, ссылки и содержимое.
Использование сторонних ресурсов осуществляется на ваш риск.

 

9. Мониторинг информации

POLYGLOTWORKS не гарантирует актуальность или точность информации.
POLYGLOTWORKS оставляет за собой право удалять или изменять контент по собственному усмотрению.

 

10. Вирусы

POLYGLOTWORKS не гарантирует отсутствие вредоносного кода.
Вы несете ответственность за защиту своих устройств.

 

11. Ограничение ответственности

POLYGLOTWORKS не несет ответственности за:

косвенный, специальный или штрафной ущерб,

потерю прибыли, данных или возможностей,

ущерб, вызванный использованием Веб-сайта.

Если ограничение ответственности будет признано недействительным, максимальная ответственность ограничивается суммой, уплаченной вами за услуги.

 

12. Возмещение ущерба

Вы обязуетесь возместить ущерб POLYGLOTWORKS за нарушения, в том числе:

предоставленные вами материалы,

нарушение Соглашения,

нарушение прав третьих лиц,

нарушение закона.

 

13. Освобождение от ответственности

Вы освобождаете POLYGLOTWORKS от любых требований, связанных с:

контентом третьих лиц,

материалами других пользователей,

действиями третьих сторон.

 

14. Разрешение споров

14.1 Применимое право

Соглашение регулируется законами Казахстана.

14.2 Переговоры

Стороны обязуются попытаться решить спор путем переговоров.

14.3 Подсудность

Все споры рассматриваются исключительно судами Казахстана.

14.4 Юрисдикция

Стороны признают юрисдикцию судов Казахстана.

14.5 Срок давности

Срок предъявления требований - 1 год.

14.6 Судебные расходы

Победившая сторона имеет право на возмещение судебных расходов.

 

15. Дополнительные положения

15.1 Полнота соглашения

Настоящее Соглашение и Политика конфиденциальности являются полным соглашением сторон.

15.2 Отказ от прав

Отказ от любого положения не означает отказ от других положений.

15.3 Делимость

Если часть Соглашения признана недействительной, остальная часть остается в силе.

15.4 Местные законы

Пользователь несет ответственность за соблюдение местного законодательства.

15.5 Отношения сторон

Соглашение не создает партнерства, агентских отношений или трудовых отношений.

15.6 Передача прав

POLYGLOTWORKS может передать свои права в любое время.
Пользователь не может передавать свои права без согласия POLYGLOTWORKS.

POLYGLOTWORKS, bu Sözleşmeyi istediği zaman değiştirme hakkını saklı tutar. Yapılan değişiklikler aksi belirtilmedikçe Web Sitesi’nde yayınlandığı anda yürürlüğe girer.

 

1. Tanımlar

1.1 “POLYGLOTWORKS”, Web Sitesine sahip olan ve Web Sitesini işleten sınırlı ortaklığı ifade eder.

1.2 “Web Sitesi”, https://www.polyglotworks.net adresini ve buna bağlı tüm alt sayfaları, içerikleri ve sunulan hizmetleri ifade eder.

1.3 “İçerik”, Web Sitesinde bulunan tüm materyalleri, metinleri, görselleri, grafik öğeleri, program kodlarını, medya dosyalarını, veritabanlarını ve kullanıcılar tarafından gönderilen tüm materyalleri ifade eder.

1.4 “Hizmetler”, POLYGLOTWORKS tarafından sunulan tüm ürünleri, materyalleri ve hizmetleri ifade eder.

1.5 “Kullanıcı”, Web Sitesine erişen veya Web Sitesini kullanan herhangi bir gerçek veya tüzel kişiyi ifade eder.

 

2. Amaç

Web Sitesi, eğitim amaçlı olarak sunulmaktadır.

 

3. Web Sitesinin Kullanımı

3.1 Lisans Verilmesi

POLYGLOTWORKS, Web Sitesine erişmeniz ve Web Sitesini bu Sözleşmeye uygun şekilde, kişisel veya iş amaçlı olarak kullanmanız için size sınırlı, münhasır olmayan, devredilemez bir lisans verir.

3.2 Yaş Sınırlamaları

Web Sitesi 13 yaşından küçük çocuklar için tasarlanmamıştır.
13 ile 18 yaş arasındaki kişiler Web Sitesini yalnızca ebeveyn veya yasal vasilerinin gözetimi altında kullanabilir.

3.3 Yasaklanan Davranışlar

Kullanıcılar aşağıdaki eylemleri gerçekleştirmeyi açıkça kabul etmez:

Web Sitesini, yürürlükteki yasalara veya bu Sözleşmeye aykırı şekilde kullanmak,

İçeriği, açıkça izin verilmediği sürece kopyalamak, çoğaltmak, indirmek, dağıtmak veya türev çalışmalar oluşturmak,

Robot, bot, veri kazıyıcı gibi otomatik sistemler kullanarak veri toplamak,

Web Sitesi, sunucuları veya ağlarına yönelik herhangi bir hackleme, aşırı yükleme, atlatma veya saldırı girişiminde bulunmak,

Dolandırıcılık, yanıltıcılık veya diğer yasa dışı faaliyetlerde bulunmak,

Başka bir kişiyi veya kuruluşu taklit etmek veya kimlik bilgilerini yanlış beyan etmek,

Virüs, solucan, Truva atı, zararlı yazılım veya diğer zararlı kodları yüklemek,

İzinsiz ticari mesaj, spam, zincir mesajları veya piramit şemaları göndermek,

Web Sitesinin olağan işleyişine müdahale etmek veya diğer kullanıcıların deneyimlerini bozmak.

Her türlü yetkisiz kullanım bu Sözleşme kapsamındaki tüm haklarınızı otomatik olarak sona erdirir.

3.4 Erişimin Sonlandırılması

POLYGLOTWORKS, herhangi bir Kullanıcının Web Sitesine veya Hizmetlere erişimini, sebep göstererek veya göstermeksizin, bildirim yaparak veya yapmadan sonlandırabilir veya askıya alabilir.

 

4. Sizin Tarafınızdan Sağlanan Bilgiler

4.1 Kişisel Veriler

Web Sitesi aracılığıyla sağladığınız kişisel bilgiler, Gizlilik Politikamız doğrultusunda işlenir.

4.2 İletişim Güvenliği

POLYGLOTWORKS makul teknik ve organizasyonel güvenlik önlemleri kullansa da internet üzerinden iletilen bilgilerin %100 güvenli olduğunu garanti edemez.
Web Sitesi üzerinden veri iletmenin tüm riskleri size aittir.

4.3 Gönderimler ve Lisans

Bize gönderdiğiniz her türlü bilgi, materyal, öneri, fikir veya yorum (hepsi “Gönderi” olarak adlandırılır), Gizlilik Politikası kapsamındaki kişisel veriler hariç olmak üzere gizli veya size özel kabul edilmez.

Gönderi sağlayarak POLYGLOTWORKS’e aşağıdaki hakları sınırsız olarak vermiş olursunuz:

Dünya genelinde,
Geri alınamaz,
Süresiz,
Ücretsiz,
Devredilebilir ve alt lisanslanabilir bir lisans.

Bu lisans, Gönderinizin:

kullanılması,

kopyalanması,

değiştirilmesi,

uyarlanması,

yayınlanması,

çevirilmesi,

türetilmiş eserler oluşturulması,

dağıtılması,

her türlü ortamda kamuya açık şekilde gösterilmesi

gibi tüm işlemleri içerir.

4.4 Yasaklı Gönderiler

Gönderileriniz aşağıdakileri içeremez:

İzinsiz ticari reklamlar,

Başkalarının telif hakkını veya fikri mülkiyet haklarını ihlal eden içerik,

Yanıltıcı, sahte veya dolandırıcı bilgiler,

Aşağılayıcı, tehditkar, taciz edici, müstehcen veya başka şekilde hukuka aykırı içerik,

Virüs veya zararlı yazılım,

Web Sitesinin yapısını atlamaya yönelik robot veya bot kullanımı.

 

5. Fikri Mülkiyet Hakları

POLYGLOTWORKS, markası ve Web Sitesi ile ilgili tüm fikri mülkiyet haklarının sahibidir:

Telif hakları,

Ticari marka ve hizmet markaları,

Ticari adlar ve kurumsal kimlik,

Logolar,

Patentler,

Ticari sırlar,

Kod, tasarım, düzen, grafikler, metin, görüntü, video ve ses içerikleri.

Tüm haklar saklıdır.
Bu Sözleşme kapsamında size açıkça verilmiş haklar dışında hiçbir hak tanınmamaktadır.

 

6. Üçüncü Taraf Fikri Mülkiyet Hakları

6.1 Politika

POLYGLOTWORKS, üçüncü tarafların fikri mülkiyet haklarına saygı duyar.

6.2 İhlal Bildirimi

Yalnızca hak sahibi veya yetkili temsilcisi ihlal bildirimi gönderebilir. Bildirim şu bilgileri içermelidir:

Yetkili kişinin imzası,

İhlal edildiği iddia edilen eserin tanımı,

İhlal eden materyalin nerede bulunduğuna dair bilgi,

İletişim bilgileriniz,

İyi niyet beyanı,

Beyanınızın doğruluğuna dair yeminli ifade.

6.3 Karşı Bildirim

İçeriğiniz bir ihlal şikayeti nedeniyle kaldırıldıysa, karşı bildirim gönderebilirsiniz. Karşı bildirim şunları içermelidir:

İmzanız,

Kaldırılan materyalin tanımı,

Yanlışlıkla kaldırıldığına dair iyi niyet beyanı,

İletişim bilgileriniz ve yargı yetkisini kabul ettiğinize dair ifade.

 

7. Feragatnameler

Web Sitesi ve POLYGLOTWORKS tarafından sunulan tüm içerik ve hizmetler “OLDUĞU GİBİ” ve “MEVCUT DURUMDA” sağlanır.

POLYGLOTWORKS, aşağıdaki garantiler dahil hiçbir açık veya zımni garanti vermez:

Satılabilirlik,

Belirli bir amaca uygunluk,

Doğruluk veya güvenilirlik,

İçeriğin eksiksizliği.

POLYGLOTWORKS, aşağıları garanti etmez:

Web Sitesinin kesintisiz veya hatasız çalışacağını,

Hataların düzeltileceğini,

Sunucuların virüssüz olacağını,

Kullanım sonuçlarının beklentilerinizi karşılayacağını.

Web Sitesini kullanımınızdan kaynaklanan tüm riskler size aittir.

 

8. Üçüncü Taraf Web Siteleri

Web Sitesi üçüncü taraf sitelere bağlantılar içerebilir.
POLYGLOTWORKS, bu sitelerin içeriğinden, doğruluğundan veya güvenliğinden sorumlu değildir.

Bu siteleri kullanımınız tamamen sizin sorumluluğunuzdadır.

 

9. Bilgi İzleme ve Güncellemeler

POLYGLOTWORKS, Web Sitesindeki bilgilerin doğru olmasını amaçlasa da:

Bilgiler güncel olmayabilir,

Eksik veya hatalı olabilir.

POLYGLOTWORKS, kullanıcı gönderilerini izlemek zorunda değildir ancak istediği zaman düzenleyebilir veya kaldırabilir.

Gerekli hallerde hukuka uygun olarak kolluk kuvvetleriyle işbirliği yapabilir.

 

10. Virüsler

Web Sitesinin virüslerden veya zararlı kodlardan tamamen arınmış olduğuna dair garanti verilmez.
Cihaz güvenliğinizden siz sorumlusunuz.

 

11. Sorumluluk Sınırlaması

POLYGLOTWORKS hiçbir durumda aşağıdaki türdeki zararlardan sorumlu olmaz:

Dolaylı, özel, cezai veya sonuçsal zararlar,

Kâr, veri veya iş kaybı,

Web Sitesine erişememe veya kullanılamama,

Her türlü hukuki teori kapsamında ortaya çıkan zararlar.

Bir mahkeme bu sınırlamaları geçersiz sayarsa, maksimum sorumluluk tutarı, sizin POLYGLOTWORKS’e ödediğiniz hizmet bedeli ile sınırlıdır.

 

12. Tazminat

 

Aşağıdaki durumlardan doğan tüm zararları POLYGLOTWORKS’e tazmin etmeyi kabul edersiniz:

Web Sitesini kullanımınız,

Gönderileriniz,

Bu Sözleşmeyi ihlal etmeniz,

Üçüncü taraf haklarını ihlal etmeniz,

Yasal soruşturma veya süreçlere sebep olan davranışlarınız,

Her türlü yasa ihlali.

 

13. Feragat

Aşağıdaki durumlar için POLYGLOTWORKS’ü tamamen serbest bırakırsınız:

Üçüncü taraf içerikleri,

Diğer kullanıcıların gönderileri,

Üçüncü tarafların faaliyetleri.

 

14. Uyuşmazlık Çözümü

14.1 Uygulanacak Hukuk

Bu Sözleşme ve Web Sitesi ile ilgili tüm uyuşmazlıklar Kazakistan yasalarına tabidir.

14.2 Müzakere

Taraflar, resmi bir süreç başlatmadan önce uyuşmazlığı iyi niyetle müzakere etmeyi kabul eder.

14.3 Yetkili Mahkeme

Tüm uyuşmazlıklar yalnızca Kazakistan’da bulunan yetkili mahkemelerde görülür.

14.4 Yargı Yetkisi

Taraflar, Kazakistan mahkemelerinin yargı yetkisini kabul eder.

14.5 Süre Sınırı

Tüm talepler, ortaya çıktığı tarihten itibaren 1 yıl içinde ileri sürülmelidir.

14.6 Masraflar

Dava sonucunda kazanan taraf, makul avukatlık ücretlerini ve masrafları talep edebilir.

 

15. Ek Hükümler

15.1 Tüm Sözleşme

Bu Sözleşme ve Gizlilik Politikası, taraflar arasındaki tam anlaşmayı oluşturur.

15.2 Feragat

POLYGLOTWORKS’ün herhangi bir hakkı kullanmaması, bu haktan feragat ettiği anlamına gelmez.

15.3 Bölünebilirlik

Herhangi bir hükmün geçersiz sayılması, diğer hükümleri etkilemez.

15.4 Yerel Yasalar

Web Sitesine erişim bazı ülkelerde yasal olmayabilir. Bu erişimi sağlama kararı tamamen kullanıcının sorumluluğundadır.

15.5 Taraf İlişkisi

Bu Sözleşme; ortaklık, acentelik, işveren-çalışan veya franchise ilişkisi oluşturmaz.

15.6 Devredilebilirlik

POLYGLOTWORKS bu Sözleşmeyi istediği zaman devredebilir.
Kullanıcı, yazılı izin olmadan haklarını devredemez.
